The Unified Patent Court
The Unified Patent Court (UPC) is a court system established within the European Union (EU) that aims to provide a uniform and efficient framework for patent litigation across Europe. The court includes judges from all participating member states of the EU and will have exclusive jurisdiction over unitary patents and classic European patents.
Ratification by Baltic States
The UPC agreement has already been ratified by 17 member states, including the Baltic countries of Latvia, Lithuania, and Estonia. The agreement will enter into force on the first of June this year.
Exclusive Jurisdiction
The UPC will have exclusive jurisdiction for both unitary patents and classic European patents. However, during the transition period, there will be certain exceptions for classic European patents, which may still be brought under national courts or other competent national authorities.
Opt-Out Option
Existing classic European patents will have the option to “opt-out” and exclude themselves from the jurisdiction of the UPC. It is crucial for European patent owners to carefully consider their strategic needs and decide whether opting out is necessary to protect their rights in the Baltic States.
Court System
The UPC will consist of a Court of First Instance and a Court of Appeal. In addition, there will be a Patent Mediation and Arbitration Centre intended to promote amicable settlements.
