Estonia is a member of the European Patent Organization (EPO), which is an organization that grants patents within the contracting European states under the European Patent Convention (EPC).
In total, together with the contracting, extension and validation states, there are 44 states within the EPO. In the EPC it is stated that the European patent in each of the EPO contracting states, must be subject to the same conditions as the national patent of the respecting country.
Estonia has not yet signed the London Agreement, which aims at reducing the costs of European patent translations, and it is required to submit the Estonian translation of the full patent – the claims, the description, the title and the drawings.
The validation of the patent must be filled out within three months after the publication of a European patent application by the European Patent Office in the official edition of the European Patent Office.
To maintain the validity of the European patent in Estonia, it is necessary to pay a state fee for every year of validity, which has to be paid to the Estonian Patent Office, starting from the time when the grant of the European patent by the European Patent Office.
The Power of Attorney is not needed for the validation of the European patent in Estonia.
